Use of personal data collected

Contact forms

When you send us a message using the site's contact form, an email is sent to us. The personal data you send us will only be used for the purpose of contacting you again to follow up your request. The data submitted is not stored on the site.

Cookies

If you go to the login page, a temporary cookie will be created to determine whether your browser accepts cookies. It does not contain any personal data and will be deleted automatically when you close your browser.

When you log in, we will set a number of cookies to record your login details and screen preferences. The lifetime of a login cookie is two days. If you tick "Remember me", your login cookie will be stored for a fortnight. If you log out of your account, the connection cookie will be deleted. A cookie with a lifetime of one year is also placed on your computer once you have declared your age. This enables us to remember that you are of legal age and that you are authorised to browse the site.

Storage periods for your data

For "Blue Smokers" who register on our site, we also store the personal data indicated in their profile. All members can view, modify or delete their personal information at any time (with the exception of the name used to log in). Our administrators also have access to this data if necessary.

The rights you have over your data

If you have an account, you may request to receive a file containing all the personal data we hold about you, including that which you have provided to us. You may also request the deletion of your personal data. This does not include data stored for administrative, legal or security purposes.

Terms and conditions of sale

Prices

All prices displayed on the site are in Swiss Francs (CHF) and include VAT unless otherwise stated. Packaging and handling costs are included in the prices shown.

Payment

The payment methods accepted may depend on your purchase and delivery method. The methods available are displayed during the purchase process.
In the case of payment by invoice, payment must be made within 30 days.
Orders for filled humidors will not be dispatched until payment has been received.

Shipping

Shipping charges may apply depending on your purchase and delivery method. These costs are displayed during the purchase process. We only ship our products to addresses in Switzerland and Liechtenstein.

Orders are sent by post only. Delivery times may vary between 2 and 7 days for orders.

Subscriptions are delivered once a month around the 20th. Orders must be received by the 15th to guarantee delivery during the current month.

Age

The content of this site is intended for adults (18 years of age) resident in Switzerland or Liechtenstein. The consumption and purchase of tobacco products is regulated by the Swiss tobacco legislation.

Warranty and liability

All shipments are made with care. Cigars are hermetically packed (zip or humidor depending on your order).
In the event of a problem with the quality of the cigars delivered, you have 5 days from receipt to request an exchange. We will proceed with the exchange once the faulty goods have been returned and checked by us.
If the goods are no longer available, a credit note can be requested for a later order. No refunds will be made on cigars that have been smoked or returned outside their protective case (if available).

In the event of damage to the parcel, the recipient is responsible for notifying the Post Office of the damage within the specified time limit.

Order cancellation

An order can be cancelled if payment has not been made.

Cancellation procedure

If you have a subscription, you will be notified when the last delivery is made with a renewal offer.
The renewal fee is that shown on the the subscription product page.

The duration of the subscription is that chosen at the time of purchase.
There is no tacit renewal at the end of the period.

Once renewed, it is valid until the end of the chosen period.

Pause

If necessary, the subscription can be paused for a maximum of 3 months for each renewal.

Start date

When you purchase a new subscription, you have the option of starting at a later date. To do this, please contact us by email at info@bluesmokespirit.ch, quoting your order number.

Form and validity

These conditions are valid from 27 March 2024 and replace all other conditions.

The Code of Obligations governs all other cases.

The place of jurisdiction is Sion (Switzerland), which the customer has been made aware of.
