Use of personal data collected

Contact forms

When you send us a message via the website’s contact form, an email is sent to us. The personal data you provide is used solely for the purpose of contacting you in response to your enquiry. The data submitted is not stored on the website.

Communication and promotional marketing

We send out our special offers and marketing information, as well as details of our monthly selections, via various channels which you can subscribe to (text message, WhatsApp, email, post).
You can unsubscribe from these channels at any time. You will continue to receive
communications relating to your purchases and subscription.

Cookies

If you visit the login page, a temporary cookie will be created to determine whether your browser accepts cookies. It does not contain any personal data and will be automatically deleted when you close your browser.

When you log in, we will set a number of cookies to store your login details and screen preferences. A login cookie lasts for two days. If you tick ‘Remember me’, your login cookie will be retained for two weeks. If you log out of your account, the login cookie will be deleted. A cookie with a lifespan of one year is also placed on your computer once you have confirmed your age. This allows us to remember that you are of legal age and authorised to browse the site.

Retention periods for your data

For ‘Blue Smokers’ who register on our website, we also store the personal data provided in their profile. All members can view, edit or delete their personal information at any time (with the exception of the username they use to log in). Our administrators also have access to this data where necessary.

Your rights regarding your data

If you have an account, you can request a file containing all the personal data we hold about you, including the data you have provided to us. You can also request the deletion of your personal data. This does not apply to data stored for administrative, legal or security purposes.

Terms and Conditions of Sale

Price

All prices shown on the website are inclusive of all taxes (TTC) in Swiss francs (CHF), unless otherwise stated. Packaging and handling charges are included in the prices shown.

Payment

We accept payments via TWINT or on account. The payment method options will be displayed during the checkout process.
For payments on account, payment is due within 30 days.
For orders of pre-filled humidors, dispatch will only take place once payment has been received.

Delivery

Delivery charges may apply depending on your purchases and the delivery method chosen. These charges are shown during the checkout process. We only deliver our products to addresses in Switzerland or Liechtenstein.

Delivery is by post only. Delivery times are usually between 2 and 7 working days.

Subscriptions are delivered once a month, around the 21st. Orders must be received by us by the 15th to ensure delivery during the current month.

Age

The content of this website is intended for adults (aged 18 and over) who are resident in Switzerland or Liechtenstein. The consumption and purchase of tobacco products are regulated by Swiss tobacco legislation.

Warranty and Liability

All items are dispatched with care. Cigars are packed in airtight packaging (zip-lock bag or humidor, depending on your order).
Should you discover a manufacturing fault or quality issue upon receipt, you have 5 days from the date of receipt to request an exchange. We will process the exchange once the faulty goods have been returned and inspected by us.
If the goods are no longer available, a credit note may be requested for a future order. No refunds will be given for cigars that have been smoked or returned without their protective case (where applicable).

In the event of damage to the parcel, the recipient is responsible for reporting the damage to the Post Office within the specified time limit.

Conclusion of the contract

The contract is deemed to have been concluded upon acceptance of the order by Blue Smoke Spirit. A confirmation is sent to the customer by email.

Order cancellation

An order can be cancelled as long as it has not yet been dispatched.

Terms of termination

Subscriptions are never renewed automatically. Before your subscription expires, we will simply offer you the option to renew it if you wish to continue using the service. The renewal price is the price shown on the subscription’s product page.

Once the renewal has been completed, it remains valid until the end of the selected period.

Pause

The subscription can be paused, on request, for a maximum of three months per subscription period.

Start date for subscriptions

Would you like to give a subscription as a gift or start it on a specific date? Please contact us after placing your order, quoting your order number. We will arrange for your subscription to start on the date you require.

Unless you specify otherwise, your subscription will start from your current selection, subject to availability.

Tasting notes in the app

The Blue Smoke app allows you to maintain a personal humidor and write tasting notes (star ratings and comments). This information is saved to your customer account.

The Blue Smoke Spirit team has access to these reviews and may consult them for the sole purpose of improving its offering, in particular the range of cigars featured in its selections. The text of your reviews is never published: only the star rating may be made public, and only if you choose to do so. This data is not shared with any third parties.

You can request that this data be deleted at any time by contacting us.

Tasting data in the app

The Blue Smoke app lets you keep a personal humidor and write tasting reviews (star rating and comments). This data is stored with your customer account.

The Blue Smoke Spirit team has access to these reviews and may consult them for the sole purpose of improving its offer, in particular the choice of cigars in its selections. The text of your reviews is never published: only the star rating can be made public. This data is never shared with third parties.

You can request deletion of this data at any time by contacting us.

Governing law and validity

These terms and conditions come into effect on 15 August 2026 and supersede all other terms and conditions.

The Law of Obligations covers all other cases.

The place of jurisdiction is Sion (Switzerland), a fact of which the client has been made aware.
